1<\/span>Purpose and scope<\/h2>\n<p>These Terms of Sale (the \u201cTerms\u201d) govern online sales of DRAXX SPORTS branded products concluded on the website <strong>draxx-sports.com<\/strong> (the \u201cSite\u201d) between:<\/p>\n<ul><li><strong>TECHNODROP<\/strong>, a single-member SARL (EURL) with share capital of \u20ac1.00, registered under number RCS Chartres 883 205 221, VAT FR50883205221, with registered office at 34 rue du G\u00e9n\u00e9ral de Gaulle, 28500 Charpont, France, e-mail contact@draxx-sports.com, telephone +33 6 16 49 57 92 (the \u201cSeller\u201d);<\/li>\n<li>any natural person acting for purposes outside their trade, business, craft, profession or farming activity (the \u201cCustomer\u201d).<\/li><\/ul>\n<p>Sales to clubs, associations and businesses may be subject to specific terms. The Customer declares that they have legal capacity to enter into a contract; if they are a minor, they declare that they are acting with the consent of their legal guardian.<\/p>\n<p>The applicable Terms are those in force on the date of the order. They are available on the Site at all times and can be downloaded and printed. Confirming an order constitutes acceptance of the Terms.<\/p>\n<\/section><section aria-labelledby=\"cgv-produits-t\" class=\"aide-art\" id=\"cgv-produits\">\n<h2 class=\"aide-art__t\" id=\"cgv-produits-t\"><span>Art. 2<\/span>Products<\/h2>\n<p>The products offered are Pro Carbon Series table tennis bats (5 Stars, 6 Stars, 7 Stars) and, where applicable, bundles and accessories. Their essential characteristics are set out on each product page: construction, weight, sponge, rubber and box contents.<\/p>\n<ul>\n<li>Weight is stated with a tolerance of \u00b15 g. The control, speed and spin ratings (out of 130) and the number of stars are DRAXX SPORTS&rsquo; own commercial benchmarks, intended for comparing models within the range; they do not constitute approval or certification.<\/li>\n<li><strong>DRAXX SPORTS products are not approved by the International Table Tennis Federation (ITTF).<\/strong> They are manufactured in line with the technical specifications set out in the rules of table tennis, without official ITTF certification, and are intended for training, club play and recreational play.<\/li>\n<li>Photographs are as accurate as possible but are not contractually binding as regards shades of colour.<\/li>\n<\/ul>\n<p>Offers are valid while stocks last. If a product becomes unavailable after the order is placed, the Customer is informed and refunded without delay, and no later than 14 days after payment.<\/p>\n<\/section><section aria-labelledby=\"cgv-prix-t\" class=\"aide-art\" id=\"cgv-prix\">\n<h2 class=\"aide-art__t\" id=\"cgv-prix-t\"><span>Art. 3<\/span>Price<\/h2>\n<p>Prices are shown in euros, inclusive of all taxes (VAT of the country of delivery applicable on the day of the order), excluding delivery charges. Delivery charges and, where applicable, instalment payment fees are shown before the order is confirmed.<\/p>\n<p>Prices are displayed and invoiced in euros. For deliveries to the United Kingdom, they are displayed and invoiced in pounds sterling (GBP); the amount due is the one displayed and confirmed when the order is placed. No customs duties are payable on delivery: the products are shipped from stock located in the European Union or the United Kingdom.<\/p>\n<p>The Seller may change its prices at any time; the applicable price is the one displayed when the order is confirmed. Any announced price reduction is calculated against the lowest price charged during the 30 days preceding the reduction.<\/p>\n<\/section><section aria-labelledby=\"cgv-commande-t\" class=\"aide-art\" id=\"cgv-commande\">\n<h2 class=\"aide-art__t\" id=\"cgv-commande-t\"><span>Art. 4<\/span>Orders<\/h2>\n<p>The Customer places an order by following these steps:<\/p>\n<ol>\n<li>selecting the products, option and quantities, and adding them to the basket;<\/li>\n<li>identification (logging in to an account, creating an account or checking out without an account, if offered);<\/li>\n<li>choosing the delivery address and delivery method;<\/li>\n<li>choosing the payment method;<\/li>\n<li>checking the order summary (products, total price including VAT, charges, lead times), with the option to correct any input errors, and accepting the Terms;<\/li>\n<li>confirming by clicking the \u201cOrder with obligation to pay\u201d button and paying.<\/li>\n<\/ol>\n<p>The contract is concluded when payment is confirmed. The Seller sends the Customer an e-mail confirmation setting out the details of the order and these Terms. Orders are archived on a durable medium; the Customer can access them from their customer account or on request.<\/p>\n<p>The Seller may refuse or cancel an order that appears abnormal (unusual quantities, suspected fraud) or that is placed by a Customer with whom there is a previous payment dispute.<\/p>\n<\/section><section aria-labelledby=\"cgv-paiement-t\" class=\"aide-art\" id=\"cgv-paiement\">\n<h2 class=\"aide-art__t\" id=\"cgv-paiement-t\"><span>Art. 5<\/span>Payment<\/h2>\n<p>The price is payable in full at the time of ordering, by bank card (CB, Visa, Mastercard), PayPal, Apple Pay or Google Pay. Payments are processed by secure payment providers; the Seller never has access to full card details. Strong customer authentication (3-D Secure) may be requested by the Customer&rsquo;s bank.<\/p>\n<p>If payment authorisation is refused, the order is cancelled. The products remain the property of the Seller until the price has been paid in full.<\/p>\n<\/section><section aria-labelledby=\"cgv-livraison-t\" class=\"aide-art\" id=\"cgv-livraison\">\n<h2 class=\"aide-art__t\" id=\"cgv-livraison-t\"><span>Art. 6<\/span>Delivery<\/h2>\n<p>The products are delivered to the address given by the Customer, within the areas offered when the order is placed: mainland France (including Corsica), European Union countries and the United Kingdom. The French overseas departments and territories are not served, nor are territories outside the scope of European Union VAT or with a special tax regime (in particular the Canary Islands, Ceuta, Melilla, Madeira, the Azores and the \u00c5land Islands).<\/p>\n<p>Orders delivered within France are shipped within 48 working hours via Colissimo, with an estimated delivery time of 3 to 5 working days after dispatch; delivery costs: \u20ac4.90 (including VAT), free for orders over \u20ac25 (including VAT). Orders delivered to other countries are shipped from the Seller&#039;s Amazon warehouses in Europe and the United Kingdom within 48 working hours, with an estimated delivery time of 3 to 5 working days after dispatch; delivery costs: \u20ac9.90 (including VAT), free for orders over \u20ac49 (including VAT) within the European Union; \u00a37 (including VAT), free for orders over \u00a335 (including VAT) in the United Kingdom. Applicable costs are displayed before order confirmation.<\/p>\n<p>The Seller delivers no later than the date or within the time frame stated when the order is placed or, failing that, within 30 days of the conclusion of the contract. In the event of failure to do so, the Customer may, after requiring the Seller to make the delivery within a reasonable additional period, terminate the contract if the Seller has not performed within that period (Articles L216-1 et seq. of the French Consumer Code). Any sums paid are then refunded within 14 days at the latest.<\/p>\n<p>If a parcel is damaged or incomplete, the Customer is asked to report this to the carrier on delivery and to inform customer service as soon as possible, with supporting photos, to help process the claim. Doing so does not deprive the Customer of any of their rights.<\/p>\n<\/section><section aria-labelledby=\"cgv-risques-t\" class=\"aide-art\" id=\"cgv-risques\">\n<h2 class=\"aide-art__t\" id=\"cgv-risques-t\"><span>Art. 7<\/span>Transfer of ownership and risk<\/h2>\n<p>Ownership is transferred upon full payment of the price. In accordance with Article L216-4 of the French Consumer Code, the risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by them other than the carrier proposed by the Seller, takes physical possession of them.<\/p>\n<\/section><section aria-labelledby=\"cgv-retractation-t\" class=\"aide-art\" id=\"cgv-retractation\">\n<h2 class=\"aide-art__t\" id=\"cgv-retractation-t\"><span>Art. 8<\/span>Right of withdrawal<\/h2>\n<h3>Period<\/h3>\n<p>In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has <strong>fourteen (14) days<\/strong> to withdraw, without having to give reasons for their decision or bear any costs other than those set out below. The period runs from the date on which the product is received by the Customer or a third party designated by them. For an order of several products delivered separately, it runs from receipt of the last product.<\/p>\n<h3>Exercising the right<\/h3>\n<p>The Customer can exercise this right directly online, free of charge and without creating an account, using the withdrawal function \u201c <a href=\"\/en\/withdraw-from-the-contract\/\">Withdraw from the contract here<\/a> \u201d (Article L221-21 of the French Consumer Code), permanently available from the site footer, the customer account and the order e-mails; they immediately receive an acknowledgement of receipt by e-mail stating the content of their declaration and its date and time.<\/p>\n<p>They may also notify their decision before the period expires, using the <a href=\"#annexe-formulaire\">model form in the appendix<\/a> or any other unequivocal statement, sent by e-mail to contact@draxx-sports.com, from their customer account or by post to the Seller&rsquo;s address. The Seller acknowledges receipt without delay on a durable medium.<\/p>\n<h3>Returning products<\/h3>\n<p>The Customer returns the products, complete and in their original packaging if possible, no later than 14 days after communicating their decision. The direct cost of returning the products is borne by the Customer. The Customer is only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning (for example: use in play, marks from impacts or glue on the rubbers).<\/p>\n<h3>Refund<\/h3>\n<p>The Seller refunds all sums paid, including the original delivery charges, no later than 14 days from the date on which it is informed of the decision to withdraw. Additional costs arising from the choice of a delivery method more expensive than the standard method offered are not refunded. The Seller may withhold the refund until it has received the products back or until the Customer has supplied proof of dispatch, whichever is earlier. The refund is made using the payment method used for the order, unless the Customer expressly agrees to another method, and at no cost to the Customer.<\/p>\n<h3>Exceptions<\/h3>\n<p>In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised in particular for goods made to the Customer&rsquo;s specifications or clearly personalised (for example an engraved bat, if this service is offered).<\/p>\n<\/section><section aria-labelledby=\"cgv-retours-t\" class=\"aide-art\" id=\"cgv-retours\">\n<h2 class=\"aide-art__t\" id=\"cgv-retours-t\"><span>Art. 9<\/span>30-day commercial returns policy<\/h2>\n<p>In addition to, and without prejudice to, the right of withdrawal, the Seller grants the Customer a returns and exchange policy of <strong>thirty (30) days<\/strong> from receipt. During the first 14 days, the statutory scheme under Article 8 applies; from the 15th<sup>th<\/sup> to the 30th<sup>th<\/sup> day, the following conditions apply:<\/p>\n<ul>\n<li>the product is returned new, not used in play, with no marks on the rubbers, and complete (case, box, accessories);<\/li>\n<li>the Customer registers the return from their customer account or with customer service and follows the instructions provided;<\/li>\n<li>return costs: borne by the Customer, unless the product is defective or the Seller has made an error; original delivery charges: not refunded after the 14<sup>th<\/sup> day;<\/li>\n<li>after receipt and inspection, the Seller, at the Customer&rsquo;s choice, either refunds the price of the product within 14 days or exchanges it for another model, adjusting for any difference in price.<\/li>\n<\/ul>\n<p>A product that does not meet these conditions is sent back to the Customer at the Customer&rsquo;s expense. This commercial policy in no way limits the legal guarantees.<\/p>\n<\/section><section aria-labelledby=\"cgv-garanties-t\" class=\"aide-art\" id=\"cgv-garanties\">\n<h2 class=\"aide-art__t\" id=\"cgv-garanties-t\"><span>Art. 10<\/span>Legal guarantees<\/h2>\n<p>Independently of the commercial warranty, the Seller remains liable for any lack of conformity of the goods with the contract under Articles L217-3 et seq. of the French Consumer Code, and for hidden defects in the goods sold under Articles 1641 et seq. of the French Civil Code.<\/p>\n<h3>Legal guarantee of conformity<\/h3>\n<p>The Seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery and becoming apparent within two years of delivery. Unless proven otherwise, defects becoming apparent within that period are presumed to have existed at the time of delivery. Normal wear of the rubber through use does not constitute a lack of conformity.<\/p>\n<h3>Guarantee against hidden defects<\/h3>\n<p>The Customer may invoke the guarantee against hidden defects that make the product unfit for its intended use, or that impair that use to such an extent that the Customer would not have bought it, or would have paid a lower price for it, had they known. The action must be brought within two years of discovering the defect. The Customer may then choose between cancelling the sale and a price reduction (Article 1644 of the French Civil Code).<\/p>\n<h3>How to make a claim<\/h3>\n<p>The Customer sends their request to customer service (contact@draxx-sports.com, contact form or post), stating their order number and the nature of the defect, with supporting photos if possible.<\/p>\n<div class=\"aide-box aide-box--legal\">\n<p class=\"aide-box__t\">Box \u2014 Legal guarantee of conformity and guarantee against hidden defects<\/p>\n<p>The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.<\/p>\n<p>The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.<\/p>\n<p>If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.<\/p>\n<p>If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.<\/p>\n<p>The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund upon returning the goods, if:<\/p>\n<ol>\n<li>the trader refuses to repair or replace the goods;<\/li>\n<li>the goods are repaired or replaced after a period of thirty days;<\/li>\n<li>the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;<\/li>\n<li>the lack of conformity persists despite the seller\u2019s unsuccessful attempt to bring the goods into conformity.<\/li>\n<\/ol>\n<p>The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods first.<\/p>\n<p>The consumer is not entitled to terminate the sale if the lack of conformity is minor.<\/p>\n<p>Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.<\/p>\n<p>The rights set out above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.<\/p>\n<p>A seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).<\/p>\n<p>The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect.
